The term “Parties” encompasses Mondus Capital Pty Ltd (ACN 659 284 312 (Mondus Capital)), its affiliated entities, and any other parties engaged in processing loan applications, including insurers, financiers, managers, and services. Within this privacy consent, the terms “we,” “us,” and “our” collectively refer to the aforementioned Parties.
By signing this agreement or otherwise indicating your acceptance, you consent to the Parties, along with certain other entities, collecting, using, retaining, and disclosing your personal information (including sensitive information) and credit-related information as outlined herein. Throughout our interactions, we may seek and acquire additional personal information (including sensitive data information) and credit-related information about you. This consent extends to the collection, usage, retention, and disclosure of such information. Absent this consent or the provision of your personal and credit-related information, we may be unable to facilitate or extend credit, deliver other services, verify your identity, or guard against fraud. Please note that not all provisions discussed herein may be pertinent to your circumstances.
Handling of personal and credit-related information
The Parties may collect, use, retain, and disclose personal information and credit-related information about you for various purposes, including but not limited to: facilitating or providing credit, processing your credit application, evaluating the acceptance of credit guarantees from you, managing the credit, direct marketing of our products and services, complying with legal obligations, maintaining our relationship with you, and performing administrative functions. This information may be gathered from you directly or from third-party sources.
We are legally obligated to collect your personal information to comply with Australian laws, including the Anti-Money Laundering and Counter-Terrorism Financing Act 2006 (Cth).
Credit information encompasses details such as your identity, the type, terms, and
maximum amount of credit provided, repayment history, default information (including overdue payments), details of any new credit arrangements, financial hardship arrangements (including whether you have made such arrangements with us), personal insolvency information, court records, and any serious credit infringements. Credit eligibility information refers to credit reporting information supplied by a credit reporting body and any information we derive from it. Collectively, this is referred to as ‘credit-related information’.
Personal information includes any data or opinion about an identified individual or an individual who is reasonably identifiable.
The personal information we may collect includes your name, date of birth, address,
account details, occupation, and any other necessary identifying details, including
publicly available information from public registers and social media. If you apply for
finance, we may also collect details about the number and ages of your dependents and cohabitants, the duration of your current residence, employment details, and proof of income and expenses.
We may seek and collect sensitive information about you which is relevant and
necessary to providing products and delivering our services, or to comply with the
law. This includes information or an opinion about your financial circumstances,
hardship information including information about financial difficulty or vulnerability,
and criminal history.
When using our website or mobile applications, we may collect information regarding your location or activity, such as IP address, browser type and version, telephone number, access to third-party sites, visit dates and times, pages viewed, device information such as device type, and other user location details. the end of this consent form. You may request us to correct information if you believe
your personal or credit-related information is not accurate, complete, and up to date. It is your responsibility to ensure that the personal information you provide is
accurate, complete and up to date.
These policies contain comprehensive details about how you may access or request
correction of your personal information and credit-related information, the management of such information, and the procedure for lodging a complaint about a privacy breach and how such complaints are handled.
They also include information on 'notifiable matters', which cover the following:
- The information we use to assess your creditworthiness.
- The possibility of CRBs providing your personal and credit-related information to credit providers to assist in assessing your creditworthiness.
- The consequences of failing to meet your credit obligations or committing a serious credit infringement include our right to report such defaults or infringements to CRBs.
- Your right to request that CRBs do not use your credit-related information for pre-screening credit offers.
- Your right to request a CRB not to use or disclose credit-related information about you if you believe you are a victim of fraud.
We may update the terms of our Privacy Policy from time to time at which time we will publish those changes on our website. If we make a significant change to our Privacy Policy, for example changing a lawful basis on which we process your personal information, we will ask you to re-consent to the amended Privacy Policy.
Customer and commercial credit-related information
We may exchange your commercial and consumer credit-related information with the entities listed below to assess an application for consumer or commercial credit and manage that credit, including the collection of any overdue payments. Specifically, we can obtain credit-related information about you from a Credit Reporting Body (CRB) that provides both consumer and commercial credit-related information.
Exchange of information with credit providers
We may exchange your personal and credit-related information with other credit
providers to assess your creditworthiness, credit standing, credit history, or credit
capacity.
Disclosure of information to guarantors
We may disclose your personal and credit-related information to any individual (or their authorised representative) who proposes to guarantee or has guaranteed the
repayment of any credit provided to you or who indemnifies you in any way.
Exchange of Information
We may exchange personal information and credit-related information with various
entities, some of which may be located overseas. Please refer to our Privacy Policy
for detailed information. The entities with whom we may exchange information include but are not limited to:
- Credit Reporting Bodies (CRBs), including for a credit guarantee purpose.
- Introducers, including finance brokers, suppliers, mortgage managers, and individuals assisting in providing our products and services to you.
- Representatives acting on your behalf, such as financial consultants, accountants, lawyers, advisers, referees (e.g., employers verifying provided information), and representatives like executors, administrators, guardians, trustees, attorneys, and individuals holding power of attorney.
- Auditors, Accountants, Lawyers, Attorneys, and other external advisors.
- Industry or Regulatory Bodies, government authorities, tribunals, courts, or entities related to complaints regarding the approval or management of your lease or loan.
- Investors, Agents, Advisors, Trustees, ratings agencies, or entities involved in funding for credit provided to you or any entity with an interest in your finance or our business.
- Entities authorised or required by law, including under the Anti-Money Launderingvand Counter Terrorism Financing Act 2006 (Cth), government and law enforcement agencies or regulators, or with your consent.
- Entities to whom we outsource functions or external service providers, such as IT services, identity verification organisations, income and expenditure verification entities, and those involved in identifying, investigating, and preventing illegal activities such as fraud.
- Other Financial Institutions, including banks, for processing mistaken payment claims.
- Real Estate Agents.
- Medical Professionals, Facilities, or Health Authorities verifying health information provided.
- Insurers, Valuers, Debt Collection Agencies, auditors, reinsurers, and healthcare providers.
- Persons considering acquiring an interest in our business or assets.
- Suppliers of assets to you.
- Security Registration Bodies.
- Persons with an interest in the property offered as security.
- Other Borrowers or Guarantors (if more than one) or borrowers or prospective borrowers of any credit you guarantee or propose to guarantee
- Our Associates, Related Entities, or Contractors, including claims-related providers such as assessors and investigators.
- Associated Businesses interested in marketing products to you.
- Any person where you have provided us consent.
- Your referees, such as your employer, to verify information you have provided.
Customer Identification
We may disclose your name, date of birth, and address to organisations, including CRBs, to request an assessment of whether this information matches
records they hold (an “Information Match Request”). This process may involve online
electronic identity verification, matching your details with information held by the issue of the identification document (the “Official Record Holder”) through third-party systems. Alternative methods for verifying your identity may also be available.
We may utilise information from various identification documents, such as Australian
Passports, state or territory driver’s licenses, Medicare cards, citizenship certificates, birth certificates, and any other identification documents to match details with relevant registries using third-party systems and to record the results of that matching.
Information Provided About Other Individuals
If you provide us with personal information about another individual (such as your employer, spouse, referee, solicitor, etc.), you are obligated to inform them that:
- We have gathered their personal information to evaluate your application and administer the credit we extend to you.
- We may share this information with the Parties and other entities referenced in this document and our privacy policy.
- Their personal information is handled in accordance with our Privacy Policy, accessible at https://mymondus.com/privacy-policy/ or by contacting contact@mymondus.com.
- They have the right to access the information we retain about them. We may not verify whether you have fulfilled this obligation.
By providing us with information regarding another individual, you affirm that you are
authorised to do so and undertake to apprise them of the contents of this noticeconsent.
Overseas Disclosure
We may disclose your personal information and credit-related information to overseas entities, including related entities and service providers situated in various jurisdictions such as the United Kingdom, European Union, Asia Pacific, United States of America, and the Philippines.
Overseas entities may have obligations to disclose information to relevant foreign authorities under foreign law. Additional details regarding overseas disclosure are provided in the entities’ respective privacy policies. While we endeavour to engage
reputable offshore service providers, we do not assume liability for breaches or misuse of your information sent offshore. Overseas entities may not be subject to similar data protection laws. There are risks that any such third party engages in any act or practice that would contravene the data privacy laws in our jurisdiction, and this might mean that you will not be able to seek redress under our jurisdiction’s privacy laws.
Storage and Security
We may store your personal information and credit-related information in cloud or
other networked or electronic storage systems and will take reasonable measures to
safeguard its security. However, due to the global nature of electronic or networked
storage accessible via the internet, it may not always be feasible to ascertain the exact location from which your information is held or accessed.
Verification of Income
We may disclose your personal information to our intermediary, Verifier Australia Pty
Ltd (Verifier), for income verification purposes. Verifier will:
- Request access to data held by organisations regarding your superannuation contributions, payroll, and employer, utilising your right of access under the Privacy Act 1988 (Cth).
- Calculate your income and provide us with a response concerning your income and employment status.
- We will utilise the information provided by Verifier to evaluate your application. If electronic verification of your income is not feasible, an alternative option will be presented. Your personal information will not be disclosed to Verifier until your identity is verified.
- You are entitled to request access to the data Verifier obtains and their response to us at any juncture.
Marketing
We may use information collected from you to market products and services to you.

We will not charge you for giving effect to your request and will action this request within a reasonable period. Credit Reporting Bodies
We may exchange your personal information and credit-related information with the Credit Reporting Bodies listed below.
This information may be incorporated into reports that these CRBs provide to other organisations to aid in assessing your creditworthiness.
The information may be included in reports that the CRBs give other organisations (such as other lenders) to help them assess your credit worthiness. Some of the information may adversely affect your credit worthiness (for example, if you have defaulted on your loan) and, accordingly, may affect your ability to obtain credit from other lenders.

Electronic Communications Consent (ECC)
I/We hereby consent to receiving notices and other documents electronically and
authorise Mondus Capital to act on instructions sent electronically. This consent
encompasses all communications permitted by law to transpire electronically. Upon
granting this consent:
- Mondus Capital may cease sending paper copies of notices and other documents.
- I/We are obligated to regularly monitor electronic communications for notices and documents and ensure that our email address, residential address, and contact numbers are kept up-to-date.
- Mondus Capital may dispatch notices and documents via email or notify the availability of documents on a designated website.
- I/We retain the right to withdraw consent to receive electronic notices and documents at any time by notifying Mondus Capital in writing.
- I/We acknowledge that electronic documents do not modify obligations under any terms of the credit contract.
- I/We possess the necessary facilities to print electronic notices or documents.
- Mondus Capital will dispatch electronic communications to the email address provided in our loan application.

Customer acknowledgement
I/We have thoroughly reviewed and comprehended the particulars completed in the
application form and any supplementary forms associated with this application. I confirm that the information provided is true, complete, and accurate, and has been provided to Mondus Capital to facilitate its assessment regarding the provision of a new loan for which I/we formally apply.
I/We acknowledge and agree that Mondus Capital reserves the right to cancel or withdraw an application, approval, or credit offer if it deems the provided particulars to be inaccurate or false.
I/We verify that all information provided, including financial commitments, is true
and precise.
If consolidating or refinancing existing debts, I/we understand that extending the
repayment period may result in accruing additional interest and a slower buildup of
equity in the secured property.
I/We comprehend that selecting a fixed-rate loan (or split loan) entails no break cost
fees for early repayments and no break costs if the fixed-rate loan is settled prior to the fixed term's conclusion.
I/We acknowledge the availability of rate lock for new Fixed Rate home loan applications (not applicable for loan variations) and understand that the Fixed Interest Rate Lock Authority Request must be completed and submitted to request this.
I/We acknowledge that selecting a Fixed rate interest-only loan necessitates the fixed-rate term matching the interest-only term, with the maximum interest-only term capped at 5 years.
I/We acknowledge that capitalising fees and charges to the loan will incur interest charges on these amounts.
I/We understand that if opting for a fixed-rate loan, features such as an Offset Sub- Account, Visa Debit Card, and Redraw facility are not available.
I/We acknowledge that once a valuation of the property(s) offered as security has
been conducted, there will be no refund of the application fee.
I/We understand that documentation may be requested to verify the information provided in this application.
I/We consent to receive notices and other documents electronically from Mondus Capital, with electronic communications directed to the nominated email address for the service provided in this loan application.
I/We acknowledge that Mondus Capital may cease sending paper copies of notices, statements, disclosures, and other documents.
